After much affidavits and redundant auto-forwarding malfunctions, Judge King lets Wachovia's counsel off the hook:

Default judgment would be too harsh a penalty, under these circumstances for a calendaring mistake by defense counsel' staff.

Not just his staff -- his former staff!
